Сегодня столкнулся с очередным разводом на деньги. Точнее столкнулся я уже с последствиями. Будучи у родителей наткнулся на новые покупки - на столе у моей бабушки - 90 летней пенсионерки красовались новые коробки:

набор ножей, шуруповерт, станок для стрижки, набор емкостей для жарки и некая игрушка "поющая птичка"
Все выглядит оочень красиво и презентабельно. Когда я узнал откуда все это - она поведала историю: Днем когда все были на работе в квартиру позвонили молодые люди и представились представителями нового магазина - который делает подарки жильцам близлежащих домов. За скромные 7000р они фактически дарят столь нужные в быту вещи.
Действуют они по стандартной схеме: втираются в доверие и разговор зачастую начинают с того что эти вещи они предоставляют бесплатно - вещи при этом передают тебе в руки дабы закрепить чувство собственности. Могут долго рассказывать - при этом следя за твоей реакцией. После закрепления услышанного намекают, что надо заплатить небольшой взнос - и старые люди несут зачастую последние деньги отложенные с пенсии.
Один раз они уже приходили - но тогда я был дома и выслушав их тираду, сразу после требования денег выпроводил вон. Но в этот раз старый человек не заметил подвоха и в итоге отдал чуть ли не последние свои деньги.
Сейчас уже делать что-то бесполезно. Думаю, что в следующий раз если они вдруг придут я их проучу и не буду пускать их в квартиру, вещи предлагаемые ими возьму, и сразу после того как они скажут, что это подарок - закрою перед ними дверь. Под подарками по закону, согласно статье № 572 ГК РФ подразумевается безусловная передача вещи с однозначным переходом права собственности к одариваемому. А требование денег за подарки с их стороны является составом преступления предусмотренным статьёй № 163 УК РФ 'Вымогательство'". Так же есть статьи № 159 УК РФ "Мошенничество" которой их вполне можно припугнуть. Раскладывание вещей в квартире может рассматриваться как акт исполнения статьи № 236 ГК РФ - "активные действия которые демонстрируют отказ от права собственности". Если же они попробуют проникнуть в квартиру тут статья № 139 УК РФ "Незаконное проникновение в жилище", а попытка отнять подарки - статья 161 УК РФ "Грабёж".
Надеюсь, что если не я то хотя-бы кто-то другой их обязательно проучит. Такие ублюдки который обманывают пенсионеров должны гореть в аду.
