На президентских выборах 2012 г. я был (и пока остаюсь) членом комиссии с правом решающего голоса на участковом избирательном участке №12 в Адмиралтейском районе Санкт-Петербурга. Как я им стал – отдельная история; отмечу только, что я был выдвинут партией «Яблоко».
Я заранее готовился к худшему, готовился к возможным нарушениям, готовился к тому, что меня могут отстранить от работы, готовился препятствовать вбросам, каруселям и прочим стандартным нарушениям. Статус члена комиссии с решающим голосом делал меня практически неуязвимым к нападкам комиссии: согласно действующему законодательству люди с таким статусом могут быть отстранены от работы комиссии (в отличие от наблюдателей, которых можно удалить).
Тем не менее, ожидания были худшие и на участок мы пришли в команде с Вадимом Баткиным. Вадим получил направление наблюдателя от Миронова С.М.
Во время работы в комиссии накануне дня голосования и в день голосования я указывал на нарушения, недостатки и недочеты в работе комиссии. Вместе с Вадимом нам удалось добиться устранения нескольких нарушений. Пару раз удалось избежать удаления Вадима с участка. Даже произошел «забавный инцидент»: на участок пришел молодой человек в состоянии алкогольного опьянения и, размахивая бюллетенем, полученном на соседнем участке, громко поинтересовался, кому можно продать голос. Мне удалось его задержать и привлечь внимание сотрудников полиции, которые его сопроводили на соседний избирательный участок, где он (как говорят) и опустил бюллетень в урну. Оставим и этот вопрос на отдельное обсуждение.
Почему? Потому что все это меркнет в сравнении с тем, что произошло прямо перед закрытием участка.
Чуть позже семи часов вечера один из псевдообщественных контролеров (к сожалению, пока не знаю фамилии) устно пожаловался председателю комиссии на «предвзятое отношение одного из наблюдателей к членам комиссии» и «желание найти этим наблюдателем какие-то нарушения в работе комиссии». В связи с этим председатель комиссии собрала заседание комиссии с тем, чтобы удалить наблюдателя Баткина В. с участка. Ему вменили «видео и фото контроль за волеизъявлением гражданина» (одно слово – клевета), «заставил написать избирателя жалобу» (избирателя в очередной раз не было в основном списке, что вызвало крики и ругань; жалоба – наиболее благоприятное решение вопроса), «искал компроматы на избирательную комиссию» (уж не знаю, что имеется в виду). Я категорически оспаривал удаление наблюдателя, отмечая, что им не было нарушено законодательство, он не препятствовал работе комиссии, его деятельность либо способствовала исправлению текущих недочетов, либо вела к повышению качества работы комиссий в будущем. Несмотря на это 10 членов комиссии из 11 (все кроме меня) проголосовали за удаление наблюдателя. Я, конечно, проголосовал против и отразил это в особом мнении к решению комиссии.
Следующим вопросом на этом заседании стал вопрос об отстранении от работы и удалении с участка члена комиссии с правом решающего голоса, т.е. меня. Я несколько раз озвучил незаконность такого удаления, постарался показать абсурдность аргументов председателя комиссии.

Nevertheless, the expectations were worse and we came to the site in a team with Vadim Batkin. Vadim received the direction of the observer from S. Mironov.
While working on the commission on the eve of election day and on election day, I pointed out violations, shortcomings and shortcomings in the work of the commission. Together with Vadim, we managed to eliminate several violations. A couple of times managed to avoid the removal of Vadim from the site. There was even a “funny incident”: a young man was drunk and came to the polling station, waving a ballot received at a neighboring polling station, he loudly asked who he could sell his voice to. I managed to detain him and attract the attention of the police, who escorted him to a nearby polling station, where he (as they say) and put the ballot in the ballot box. Let us leave this question for a separate discussion.
Why? Because all this fades in comparison with what happened right before the closure of the site.
A little after seven o’clock in the evening, one of the pseudo-public controllers (unfortunately, I don’t know the name yet) verbally complained to the chairman of the commission about “a biased attitude of one of the observers to the members of the commission” and “a desire to find any violations in the commission’s work by this observer”. In this regard, the chairman of the commission convened a meeting of the commission in order to remove observer Batkin V. from the polling station. He was charged with “video and photo control over the citizen’s will” (one word - slander), “forced the voter to write a complaint” (the voter was again not on the main list, which caused screaming and abuse; the complaint is the most favorable solution to the question), “ I was looking for incriminating evidence on the election commission ”(I don’t know what is meant). I categorically challenged the removal of the observer, noting that he had not violated the law, he did not interfere with the work of the commission, its activities either contributed to the correction of current shortcomings, or led to an improvement in the quality of the work of the commissions in the future. Despite this, 10 out of 11 members of the commission (all except me) voted to remove the observer. Of course, I voted against and reflected this in a dissenting opinion to the decision of the commission.
The next issue at this meeting was the question of removal from work and removal from the site of a member of the commission with a casting vote, i.e. me. Several times I voiced the illegality of such removal, I tried to show the absurdity of the arguments of the chairman of the commission.
