В МОСКВЕ ДАН СТАРТ МУНИЦИПАЛЬНЫМ ВЫБОРАМ.
В субботу, 24 июня в выпуске № 19 Московского муниципального вестника были опубликованы решения Советов депутатов о назначении выборов в представительные органы местного самоуправления и проведения их 10 сентября 2017 года.
В соответствии с требованием ч. 2 ст. 29 Избирательного кодекса «выдвижение кандидатов в депутаты представительного органа местного самоуправления…, а также сбор подписей избирателей в поддержку их выдвижения осуществляются в течение 30 дней со дня официального опубликования (публикации) решения о назначении выборов».
То есть сдать документы, уведомляющие Территориальную избирательную комиссию о выдвижении кандидата или кандидатов нужно до 18 часов 00 минут 23 июля (воскресенье).
Для уведомления соответствующей избирательной комиссии необходимо подать заявление в письменной форме (подробнее — по ссылке), в котором согласно ст. 32 Избирательного кодекса будет содержаться следующая информация:
- фамилия, имя, отчество;
- дата и место рождения;
- адрес места жительства;
- серия, номер и дата выдачи паспорта или документа, заменяющего паспорт гражданина, наименование или код органа, выдавшего паспорт или документ, заменяющий паспорт гражданина;
- идентификационный номер налогоплательщика (при наличии);
- гражданство;
- сведения о профессиональном образовании (при наличии) с указанием организации, осуществляющей образовательную деятельность, года её окончания и реквизитов документа об образовании и о квалификации;
- основное место работы или службы, занимаемая должность (в случае отсутствия основного места работы или службы — род занятий);
- если кандидат является депутатом и осуществляет свои полномочия на непостоянной основе, в заявлении должны быть указаны сведения об этом и наименование соответствующего представительного органа;
кандидат вправе указать в заявлении свою принадлежность к политической партии либо не более чем к одному иному общественному объединению, зарегистрированному не позднее чем за один год до дня голосования в установленном законом порядке, и свой статус в этой политической партии, этом общественном объединении при условии представления вместе с заявлением документа, подтверждающего указанные сведения и подписанного уполномоченным лицом политической партии, иного общественного объединения либо уполномоченным лицом соответствующего структурного подразделения политической партии, иного общественного объединения;
- если у кандидата имелась или имеется судимость, в заявлении указываются сведения о судимости кандидата, а если судимость снята или погашена, — также сведения о дате снятия или погашения судимости.
Важный момент: если у кандидата не было судимости, то не нужно предоставлять справку об ОТСУТСТВИИ судимости. Избирательный кодекс этого не требует.
Вместе с заявлением подаются следующие документы:
- копия паспорта или документа, заменяющего паспорт;
- заверенные соответственно кандидатом или уполномоченным представителем избирательного объединения (если кандидат выдвигается от данного объединения) копии документов, подтверждающих указанные в заявлении сведения об образовании, основном месте работы или службы, о занимаемой должности (роде занятий), а также о том, что кандидат является депутатом;
- если кандидат менял фамилию, или имя, или отчество, — копии соответствующих документов;
- сведения о размере и источниках доходов кандидата, а также об имуществе, принадлежащем кандидату на праве собственности (в том числе совместной собственности), о вкладах в банках, ценных бумагах.
После получения комиссией данных документов, кандидату выдаётся письменное подтверждение получения этих документов, а также документ для открытия специального избирательного счёта.
Указанные подтверждение и документ выдаются незамедлительно после представления документов. С этого момента начинается этап сбора подписей, о котором написано по ссылке.

MOSCOW ELECTIONS ARE STARTED IN MOSCOW.
On Saturday, June 24, in issue No. 19 of the Moscow Municipal Bulletin, decisions of the Councils of Deputies on the appointment of elections to representative bodies of local self-government and their holding on September 10, 2017 were published.
In accordance with the requirements of Part 2 of Art. 29 of the Electoral Code "the nomination of candidates for deputies of the representative body of local self-government ... as well as the collection of voters' signatures in support of their nomination shall be carried out within 30 days from the date of the official publication (publication) of the decision to call the election."
That is, you must submit documents notifying the Territorial Election Commission of the nomination of a candidate or candidates by 6:00 p.m. July 23 (Sunday).
To notify the relevant election commission, it is necessary to submit an application in writing (for more details, click here), in which, according to Art. 32 of the Electoral Code will contain the following information:
- Full Name;
- Date and place of birth;
- residence address;
- the series, number and date of issue of the passport or document replacing the citizen’s passport, the name or code of the authority issuing the passport or document replacing the citizen’s passport;
- tax identification number (if any);
- citizenship;
- information on vocational education (if any) indicating the organization engaged in educational activities, the year of graduation and the details of the document on education and qualifications;
- the main place of work or service, the position held (in the absence of the main place of work or service - occupation);
- if the candidate is a deputy and exercises his powers on an intermittent basis, the application must contain information about this and the name of the corresponding representative body;
the candidate has the right to indicate in the application his membership in a political party or no more than one other public association registered no later than one year before the voting day in the manner prescribed by law, and his status in this political party, this public association, subject to the submission of with a statement of a document confirming the specified information and signed by an authorized person of a political party, other public association or an authorized person of the relevant article ukturnogo unit of a political party, other public association;
- if the candidate had or has a criminal record, the statement shall contain information about the criminal record of the candidate, and if the criminal record has been withdrawn or canceled, also information about the date the criminal record was removed or canceled.
An important point: if the candidate had no criminal record, then there is no need to provide a certificate of NO criminal record. The Electoral Code does not require this.
The following documents are submitted with the application:
- a copy of the passport or a document replacing the passport;
- copies of documents certified by the candidate or authorized representative of the election association (if the candidate is nominated from the given association) confirming the information on education, the main place of work or service, the position held (occupation), and also that the candidate is deputy;
- if the candidate changed his last name or first name or middle name, copies of the relevant documents;
- information on the amount and sources of income of the candidate, as well as on property belonging to the candidate by right of ownership (including joint ownership), on deposits in banks, securities.
After the commission receives these documents, the candidate is given written confirmation of receipt of these documents, as well as a document for opening a special election account.
The indicated confirmation and document shall be issued immediately after the submission of documents. From this moment begins the stage of collecting signatures, which is written about by reference.
