В Ростовской области экспортёры зерна приготовились к новой попытке обмана государства. Ан нет! мы их щас как разоблачим! ;)
Экспортёры сельхозпродукции Ростовской области понемногу пытаются обойти хартию, подписанную с налоговиками более года назад. Об этом заявил замглавы УФНС по региону Иван Иванов. Компании с помощью «серых» схем снова хотят получать возмещение налога на добавленную стоимость (НДС) с государства.
Суть подобных схем в том, чтобы создать между производителем зерна и экспортёром ряд афиллированных компаний-посредников (обычно более трёх). Большая часть сельхозпроизводителей, как известно, использует упрощённую систему налогообложения — Единый сельхозналог (ЕСН). Уплату государству НДС она не предполагает. Однако в ходе многократных перепродаж зерна в цепочке перекупщиков появляется компания, которая использует уже обычную систему налогообложения, закладывает в стоимость сырья НДС и обязуется уплатить его в бюджет страны. Сразу после продажи зерна такая компания пропадает, а купившая у неё зерно следующая «компания-прокладка» на законных основаниях перепродаёт его экспортёру. Который впоследствии получает право требовать возмещения НДС из бюджета страны, хотя та компания, из-за которой данный налог и был включён в стоимость зерна, уже не существует и своих обязательств перед бюджетом не исполнила.
В какой-то момент на рынке в принципе не осталось компаний, которые работали бы «в белую».
— Все экспортёры сельхозсырья пользовались механизмом, — констатирует Иванов, — позволявшим наращивать сумму НДС, подлежащую возмещению. Не думаю, что кого-то обижу таким заявлением. Потому что, во-первых, это были действительно все, а во-вторых, потому, что это так. По любому налогоплательщику мы можем это доказать.
Ситуация изменилась летом 2017 года, когда налоговики собрали в Ростове всех основных зернотрейдеров страны и стали убеждать их отказаться от услуг посредников и работать напрямую с производителями зерна.
— Изначально идея была воспринята в штыки, — рассказывает Иванов. — Однако в конечном итоге сформировалась группа крупных игроков рынка, которые поддержали хартию. На текущий момент в Ростовской области 95% экспортёров сельхозпродукции её подписали.
В ФНС говорят, что никакого принуждения к подписанию документа не было, «в хартию никого не тащили». Якобы выгода экспортёров выражалась в единых условиях для всех игроков рынка, то есть никто не мог оказаться в более выигрышном положении за счёт снижения издержек через использования «серых» схем. Сами экспортёры, на условиях анонимности, не раз намекали, что подписать хартию их «убеждали» не только налоговики, но и представители силовых структур.
Как бы то ни было, буквально за несколько месяцев хартию подписали практически все экспортёры сельхозсырья страны. “All exporters of agricultural raw materials used the mechanism,” says Ivanov, “which made it possible to increase the amount of VAT to be reimbursed. The situation changed in the summer of 2017, when the tax authorities gathered all the country's major grain traders in Rostov and began to convince them to refuse the services of intermediaries and work directly with grain producers.

The Federal Tax Service says that there was no compulsion to sign the document, "nobody was dragged into the charter." Ostensibly, the benefit of exporters was expressed in uniform conditions for all market players, that is, no one could be in a more advantageous position by reducing costs through the use of gray schemes.
