Но если почитать определение верховного суда N 123-ПЭК16, то картина то вырисовывается совсем иная! :) БИОТЕК и Тева заключили договор, по которому БИОТЕК закупал этот препарат, перепаковывал, продвигал и продавал его на территории РФ. Для этих целей провел модернизацию производства, закупил оборудование и технику, обучил персонал. БИОТЕК сотрудничал с Тева не один год. БИОТЕК заключал государственные контракты на поставку этого препарата в Минздрав. И кстати за этот получал бонусы в сумме 16.5% от цены контракта от Тева при годовой поставке более 500 000 единиц продукции. Но в один момент Тева на заявку не ответила, тем самым нарушив договор с БИОТЕК, и БИОТЕК пришлось отозвать свою заявку на участие в аукционе. А выиграла контракт почти на 3 млрд. руб. Тева через своё ООО. Причем по той же цене что ранее предлагал БИОТЕК. Так что видимо не совсем так как написал автор поста. Эти сказки надо оставить для тель-авивских бабушек. Просто Тева решила делать гешефт самостоятельно и не делиться с БИОТЕК.
