Кафе сети «АндерСон» рядом с метро Тульская в Москве открылось к концу минувшей недели после захвата рейдерами, пишет The Bell. Заведение было заблокировано неделю: 14 декабря двери были закрыты велосипедными замками, а сотрудники столкнулись с вооруженными людьми на входе, которые требовали деньги за открытие помещения.
Есть способ общения, при котором компании общаются на уровне директоров, собственников, а есть способ общения, когда тебе люди с автоматами говорят: пошли вон, ваше кафе не откроете, — объяснила основатель сети «АндерСон» Анастасия Татулова.
На закрытой двери кафе было объявление о том, что помещение «опечатано ООО «Альма Рус» и указан телефон. В этой компании заявили, что помещение арестовано по делу об об убийстве основателя сети электроники «Партия» Александра Минеева в 2014 г., и что организация получила недвижимость на ответственное хранение. На этом основании «Альма Рус» требовала, чтобы деньги за аренду перечисляли на связанный с ней счет.
«АндерСон» сначала отказывался платить «Альма Рус», так как у сети был заключен 10-летний договор аренды с ООО «Варшава». С представителями этой компании «АндерСону» связаться не удалось: следователь, к которому обратилась г-жа Татулова, объяснил: «Они либо в Лондоне, либо уже закопаны в лесу». В итоге предприниматель заплатила 1,2 млн руб., подписав договор, который, по ее словам, не имеет юридической силы. В итоге помещение разблокировали и в субботу, 22 декабря, кафе заработало, но Анастасия Татулова не уверена, что требования нового собственника на этом закончились.
По предварительным оценкам, убытки из-за простоя составили 5–6 млн руб. Кроме того, «АндерСон» в декабре дважды заплатил арендную плату, сначала ООО «Варшава», а потом — ООО «Альма Рус».
Представители «АндерСона» написали жалобы в прокуратуру, Следственный комитет и Басманный суд, требуя признать незаконными действия следователя, который посоветовал заплатить новому арендодателю, и «Альма Рус». Компания также намерена обратиться в суд и хочет добиться от следователя разъяснений. Анастасия Татулова также хочет инициировать изменения в закон, который позволил бы другим предпринимателям избежать подобных ситуаций.

On the closed door of the cafe there was an announcement that the room was “sealed by Alma Rus LLC and the telephone number was indicated. The company said that the premises were arrested in the case of the murder of the founder of the Party electronic network Alexander Mineev in 2014, and that the organization received the property for safekeeping. On this basis, Alma Rus demanded that the rent money be transferred to the account associated with it.
At first, AnderSon refused to pay Alma Rus, since a 10-year lease agreement with Warsaw LLC was concluded at the network. Anderson was unable to contact the representatives of this company: the investigator contacted by Ms. Tatulova explained: “They are either in London or already buried in the forest.” As a result, the entrepreneur paid 1.2 million rubles by signing an agreement, which, according to her, has no legal force. As a result, the premises were unblocked and on Saturday, December 22, the cafe started working, but Anastasia Tatulova is not sure that the requirements of the new owner ended there.
According to preliminary estimates, losses due to downtime amounted to 5-6 million rubles. In addition, AnderSon paid the rent twice in December, first Warsaw LLC, and then Alma Rus LLC.
Representatives of AnderSon wrote complaints to the prosecutor’s office, the Investigative Committee and the Basmanny court, demanding that the actions of the investigator who advised him to pay the new landlord, and Alma Rus be illegal. The company also intends to go to court and wants to seek clarification from the investigator. Anastasia Tatulova also wants to initiate changes to the law, which would allow other entrepreneurs to avoid such situations.
