Роспатент предлагает значительно повысить размер действующих патентных пошлин и ввести новые пошлины
На общественное обсуждение вынесен проект, которым предлагается пересмотреть величину, количество, наименования патентных и иных пошлин.
Среди планируемых изменений можно выделить следующие. Ожидается двукратное увеличение пошлины за регистрацию заявки на выдачу патента РФ на изобретение - с 1650 руб. до 3300 руб. Сейчас сверх фиксированной суммы за каждый пункт формулы изобретения свыше 25 уплачивается 250 руб. По проекту придется платить 700 руб. за каждый пункт формулы свыше 10. Повышение коснется и пошлины за регистрацию заявки на выдачу патента на полезную модель, промышленный образец.
Изменения затронут также пошлины за регистрацию товарного знака. По проекту за нее придется заплатить 16 тыс. руб. и добавить 1 тыс. руб. за каждый из классов МКТУ, для которых запрашивается регистрация, свыше пяти. Выдача свидетельства на товарный знак обой дется в 2 тыс. руб. Сейчас эти две услуги объединены, и платеж составляет 16200 руб.
В числе новых видов пошлин могут появиться следующие:
- пошлина за экспертизу по существу по заявкам на полезную модель;
- пошлина за преобразование оспариваемого патента на изобретение в патент на полезную модель.
Разработчики проекта отмечают, что при определении новых размеров пошлин была учтена инфляция и практика взимания пошлин за сходные процедуры в государствах - членах ЕАЭС.
