Постановление Правительства РФ от 07.03.2019 N 240 "Об утверждении Правил передачи Фондом перспективных исследований прав на результаты интеллектуальной деятельности, созданные по заказу Фонда перспективных исследований, а также приобретенные Фондом перспективных исследований на основании договоров, в целях их практического применения (внедрения)"
Обновлена процедура передачи Фондом перспективных исследований прав РФ на результаты интеллектуальной деятельности в целях их практического применения
В соответствии с Федеральным законом от 19.07.2018 N 206-ФЗ, которым были расширены возможности Фонда по управлению правами на результаты интеллектуальной деятельности (РИД), созданные по заказу Фонда и приобретенные им на основании договоров, утверждены новые Правила передачи Фондом прав на РИД.
Фонд сможет передавать права в интересах обороны страны и безопасности государства не только ведомствам и государственным корпорациям, но также и указанным ими юридическим лицам или организациям-разработчикам РИД в целях их использования для государственных нужд, а также при выполнении работ, оказании услуг или производстве продукции в интересах обороны страны и безопасности государства.
Определены, в том числе условия, включаемые в договор об отчуждении исключительного права на РИД, в лицензионный договор, в договор о передаче полномочий по распоряжению правами РФ на РИД, порядок уплаты патентных пошлин за поддержание патентов в силе.
Предоставление права использования РИД на основе лицензионного договора на условиях исключительной лицензии не допускается.
Признано утратившим силу аналогичное Постановление Правительства РФ от 10.05.2014 N 429.

The procedure has been updated for the Fund to transfer prospective studies of the rights of the Russian Federation to the results of intellectual activity for the purpose of their practical application.
In accordance with the Federal Law of 20.07.2018 N 206-FZ, which expanded the Fund’s capacity to manage intellectual property rights (RID) created for the Foundation and acquired by it under contracts, new rules for transferring the rights to the RID by the Fund were approved.
The Fund will be able to transfer rights in the interests of the country's defense and state security not only to departments and state corporations, but also to the legal entities or RID developers that they designate for their use for state needs, as well as when performing work, providing services or manufacturing products in interests of national defense and state security.
Defined, including the conditions included in the agreement on the alienation of the exclusive right to the RID, to the license agreement, to the agreement on the transfer of authority to dispose of the rights of the Russian Federation to the RID, the procedure for paying patent fees for maintaining patents in force.
Granting the right to use the RID on the basis of a license agreement on the terms of an exclusive license is not allowed.
It is recognized as invalid the similar Order of the Government of the Russian Federation of 10.05.2014 N 429.
