Ситуация по моему суду. Есть большие подозрения, что судья хотела ввести нас в неведение и закрыть дело. Она постоянно указывала мне, что у меня заявление не по форме ГПК и надо его переписать, хоть я уже и переписывала. В последнем заседании было всуе (надо бы запись для уверенности послушать) сказано, что ответчиков быть не может по данному делу, а надо указать "заинтересованных лиц". После изучения ГПК и общения с юристами пришли к выводу, что в гражданском деле обязательно должны присутствовать именно ответчики, иначе дело теряет смысл и его можно закрыть. В результате в суд отправилось новое заявление с указанием новой стороны участвующей в деле, без изменения статуса ответчиков, и сопроводительное письмо с требованием все замечания по форме заявления указывать в письменной форме со ссылками на ГПК.... Похоже, мне нельзя верить ни прокурору, ни судье, и ошибаться тоже нельзя.

After studying the Code of Civil Procedure and communicating with lawyers, we came to the conclusion that it is the defendants who must be present in a civil case, otherwise the case loses its meaning and can be closed. As a result, a new application was sent to the court indicating the new party involved in the case, without changing the status of the respondents, and a cover letter requesting all comments on the application form to be indicated in written form with references to the Code of Civil Procedure ... It seems that I cannot trust the prosecutor neither the judge, nor can one err.
