Маленький комментарий к утреннему решению Мосгорсуда по нашей жалобе на действия окружной избирательной комиссии №31. Сейчас мы ведем судебные тяжбы по двум взаимоисключающим решениям, из-за которых Константин Янкаускас до сих пор не может открыть избирательный счет и принять участие в выборах. Первое решение - следователя Тюрина, который отказал Янкаускасу в праве лично посетить избирком и сдать документы на выдвижение. Второе решение - "филькина грамота" самой ОИК 31, которую члены комиссии пытались сначала лично под роспись вручить Янкаускасу, а затем направили ему по почте. То есть дважды пытались спровоцировать Янкаускаса на нарушение условий домашнего ареста, о которых они были сами под роспись уведомлены.
Сегодня утром в Мосгорсуде рассматривалась наша жалоба именно на филькину грамоту ОИК 31. На основании этой бумаги руководитель отделения Сбербанка, где мы должны были открыть счет, отказала нам в такой возможности. Суд (какая "неожиданность"!) поддержал Сбербанк и одобрил выпуск подобной филькиной грамоты, несмотря на убедительные доводы нашего юриста из Партии прогресса Ивана Жданова. Будем обжаловать это решение в Верховном суде.
Жалоба на отказ следователя Янкаускасу лично посетить избирком подана нашим адвокатом по уголовному делу Сергеем Панченко в Пресненский суд. Ждем назначения даты судебного заседания.
Исхода у этого дела может быть только два. Либо одно из двух решений следователя и ОИК будет признано незаконным судами общей юрисдикции. Либо оно будет признано таковым Конституционным судом. Далее мы намерены добиваться отмены выборов по округу 31 и внесения изменения в законодательство, устраняющих возможность мешать выдвижению кандидатов, находящихся под домашним арестом.
Так что никакого судебного запрета Янкаускасу баллотироваться в депутаты, как написали некоторые СМИ сегодня, нет. Жулики и воры получили лишь маленькую передышку.

A small comment on the morning decision of the Moscow City Court on our complaint about the actions of the district election commission No. 31. Now we are conducting litigation on two mutually exclusive decisions, due to which Konstantin Jankauskas still cannot open an election account and take part in the elections. The first decision was made by investigator Tyurin, who denied Yankauskas the right to personally visit the electoral commission and hand over documents for nomination. This morning, the Moscow City Court considered our complaint specifically about the filkin letter of OIC 31. On the basis of this paper, the head of the Sberbank branch, where we were to open an account, denied us such an opportunity. The court (what a “surprise”!) Supported Sberbank and approved the issuance of a similar diploma, despite the convincing arguments of our lawyer from the Progress Party, Ivan Zhdanov. We will appeal this decision in the Supreme Court.
The complaint about the refusal of the investigator Jankauskas to personally visit the electoral commission was filed by our lawyer in a criminal case, Sergey Panchenko, in the Presnensky court. We are waiting for the appointment of the date of the hearing.
The outcome of this case can be only two. Or one of the two decisions of the investigator and the DEC will be declared illegal by the courts of general jurisdiction. Or it will be recognized as such by the Constitutional Court. Further, we intend to push for the abolition of elections in constituency 31 and the introduction of legislative amendments that preclude the possibility of interfering with the nomination of candidates under house arrest.
So there is no injunction prohibiting Jankauskas from running for deputy, as some media wrote today, no. Rogues and thieves received only a small respite.
