Примерно за 500 лет до Рождества Христова Будда выявил основные причины всех человеческих страданий, ключевые из которых - страх и неведение. В наши дни это особенно актуально, когда тебя пытаются обвинить в тяжком преступлении.
Фабула дела:
Недавно ко мне за помощью обратился молодой парень Д. с просьбой защитить его от уголовного преследования по заявлению о нападении на девушку и попытке ее изнасилования. По крайней мере, именно так он это себе представлял до первой консультации, рисуя в уме образы тюремного быта вперемежку с суицидальными картинами.
С его слов, он в компании друзей отдыхал в боулинге, где, чего уж греха таить, переборщил с алкоголем и очнулся в отделе полиции без паспорта и четких воспоминаний о том, как он туда попал. Из полиции его отпустили без лишних вопросов, как только он смог самостоятельно передвигаться.
Зато через несколько дней ему в социальных сетях стали поступать угрозы от некой молодой особы, которая сообщила, что в тот вечер он напал на неё и чуть не изнасиловал. Девушка недвусмысленно дала понять, что сняла побои, у неё есть свидетели и даже видеозапись нападения.
Юноша серьезно отнёсся к ее словам, стал искренне извиняться, объяснил, что практически ничего не помнит корме того, что действительно знакомился с какими-то девушками в боулинге, но при этом не снимает с себя ответственности, если все это было на самом деле. Поэтому он предложил девушке встретиться и лично все обсудить.
Но девушка категорически отказалась с ним встречаться и сообщила, что все дальнейшие переговоры от ее имени будет вести ее друг.
Далее ситуация стала приобретать все более угрожающую картину. Вместо хрупкой девушки на авансцене появился ее друг, судя по фотографиям из соцсетей - здоровенный татуированный амбал, который в агрессивной форме стал требовать встречи и угрожать возбуждением уголовного дела в случае, если Д. не загладит вину.
Несложно догадаться, что моего клиента перспектива встречаться с этим индивидом не устроила и общаться с ним он отказался.
Но угрозами дело не кончилось. Через несколько дней этот амбал в компании друзей оказался на пороге квартиры Д. (вспоминаем про исчезнувший паспорт с указанием адреса регистрации) и потребовал впустить его под угрозой того, что в противном случае он расскажет родственникам и соседям о том, что Д. - насильник.
К счастью, в этот момент в квартире находилась мать Д., которая не стала открывать дверь, а сразу вызвала полицию, в связи с чем визитерам пришлось ретироваться.
Поняв, что дело приобретает совсем уж зловещий оборот, Д. Решил обратиться за адвокатской помощью.

Проведя небольшое адвокатское расследование и сопоставив ряд фактов, я выяснил, что в тот день в боулинге действительно произошли некоторые события, итогом которых стало доставление моего доверителя в отдел полиции. Более того, в этот же день некой девушкой были даны объяснения о нападении на неё Д. Но из контекста ее объяснений и всей ситуации в целом мне стало понятно, что с точки зрения криминалистических и уголовно-правовых аспектов ни о каком покушении на изнасилование, а также сколь либо серьезных телесных повреждениях не могло быть и речи. Парень просто напился и в полубессознательном состоянии попытался выразить девушке свою симпатию. Но, видимо, бесконечные сериалы и передачи «Час суда» сделали своё дело. Ребятам захотелось срубить бабла с бедолаги.
После этого я связался с другом девушки и доходчиво объяснил ему, что те синяки и моральные страдания, на которые она может претендовать, не идут ни в какое сравнение с вымогательством группой лиц по предварительному сговору, заявление о котором уже лежит передо мной на столе, обильно сдобренное показаниями родственников и соседей Д., а также видеозаписью домофона по месту его жительства.
Стоит ли говорить, что мои предложения встретиться для переговоров не вызвали того рвения, с которым друзья девушки ломились к Д. домой. Скажем прямо, больше мы о них ничего не слышали. Но заявление до сих пор лежит у меня в ящике стола. На всякий случай.
Мораль очевидна. Страх, неведение и чувство вины - мощнейшие струны, дергая за которые вымогатели зачастую успевают добиться своих целей до того как жертва успевает трезво оценить ситуацию. Так уж устроен разум человека - он может либо паниковать, либо мыслить рационально. Одновременно никак. Поэтому, находясь в состоянии стресса, не верьте себе и не предпринимайте никаких действий, пока не успокоитесь и не сможете включить рациональное мышление. Мой доверитель принял единственно правильное в такой ситуации решение - поборол свой страх, отказавшись идти на поводу у вымогателей, и избавился от неведения, обратившись за профессиональной помощью.

In his words, he was in a company of friends in a bowling alley, where, to be honest, he went too far with alcohol and woke up in the police department without a passport and clear memories of how he got there. From the police, he was released without any questions, as soon as he could move on his own.
But after a few days, he received threats from social networks that came from some young lady, who said that he attacked her that evening and nearly raped her. The girl made it clear that she had shot the beatings, she has witnesses and even a video of the attack.
The young man took her words seriously, began to apologize sincerely, explained that he remembers almost nothing about the fact that he really met some girls in bowling, but at the same time he doesn’t disclaim responsibility if it all happened. Therefore, he invited the girl to meet and discuss everything personally.
But the girl categorically refused to meet with him and said that all further negotiations on her behalf would be conducted by her friend.
Further, the situation began to acquire an increasingly threatening picture. Instead of a fragile girl, her friend appeared on the proscenium, judging by photos from social networks - a hefty tattooed bastard who aggressively began to demand a meeting and threaten to initiate a criminal case if D. didn’t make amends.
It is easy to guess that the prospect of meeting with this individual did not suit my client and he refused to communicate with him.
But the threats did not end there. A few days later, this ambal in the company of friends was on the threshold of D.'s apartment (recalling the missing passport with the registration address) and demanded to let him in under the threat that otherwise he would tell his relatives and neighbors that D. was a rapist.
Fortunately, at that moment, D.'s mother was in the apartment, who did not open the door, but immediately called the police, in connection with which the visitors had to retire.

Moreover, on the same day, some girl gave explanations about the attack on her D. But from the context of her explanations and the whole situation, it became clear to me that from the point of view of forensic and criminal-legal aspects there was no attempt to rape there was no question of any serious injuries. The guy just got drunk and in a semi-conscious state he tried to express his sympathy to the girl. But, apparently, the endless serials and programs “Hour of Judgment” have done their job. The guys wanted to cut the dough with the poor fellow.
After that, I contacted the girl’s friend and lucidly explained to him that the bruises and moral sufferings for which she can claim cannot be compared with the extortion by a group of persons in a preliminary conspiracy, the statement of which already lies before me on the table, abundantly flavored with testimony from relatives and neighbors D., as well as video intercom at his place of residence.
Needless to say, my proposals to meet for negotiations did not cause the zeal with which the girl’s friends were bursting into D.’s home. Let's face it, the more we have heard nothing about them. But the statement is still in my drawer. Just in case.
The moral is obvious. Fear, ignorance and guilt are the most powerful strings, pulling for which extortionists often manage to achieve their goals before the victim has time to soberly assess the situation. This is how the mind of a person works - he can either panic or think rationally. At the same time in any way.
