1. Если вы не нарушили ПДД, то проверка документов — только на стационарных постах ДПС (Приказ МВД РФ от 2 марта 2009 г. N 185).
2. Претензии за нарушения ПДД вам может предъявить только Гибдд, а другие
службы полиции — лишь во время спецопераций (Приказ МВД РФ от 2 марта 2009 г. N 185).
3. По требованию инспектора остановитесь, но из машины не выходите. Попросите его предъявить служебное удостоверение (п. 2.4 ПДД).
4. Человек, сидящий за рулем в припаркованной машине, — не водитель, а пассажир. В этом случае предъявляйте ПТС, но не права.
5. Требуйте у инспектора доказательств вашей вины. Не оправдывайтесь, не сочиняйте легенды (ст. 49 Конституции РФ, ст. 1.5 КоАП РФ).
6. Не давайте никаких объяснений и показаний (ст. 51 Конституции РФ).
В протоколе пишите только: «Не согласен, требуется помощь адвоката»
7. Любой пассажир (сослуживец, жена) — свидетель. Каждого из них должны вписать в протокол.
8. Адвокат вам положен с момента составления протокола (ст. 25.5 КоАП РФ).
9. Требуйте копию протокола (ст. 28.2 КоАП РФ).
10. Повестка в ГАИ, суд, иные органы — только под расписку.
11. Досмотр машины — только по протоколу и с участием двух понятых (ст. 27.9 КоАП РФ).
12. Не дуйте в «трубочку». При обвинении в пьянке за рулем требуйте медицинского освидетельствования.
13. Лишить прав вас может только суд (ст. 3.8 КоАП РФ).
14. При наличии талона ТО проверка любых технических параметров машины (СО, СП, уровня тонировки стекол и т.д.) запрещена (ст. 12.1 КоАП РФ, Приказ МВД РФ от 2 марта 2009 г. N 185).
15. Снос гаражей и «ракушек» — только по решению суда.
