Согласно заявлениям федеральных и местных органов власти Российской Федерации (в том числе, но не только: Ростуризма, Роспотребнадзора, Главного государственного санитарного врача, мэрий и администраций городов и областей), в настоящий момент в мире возникла эпидемия коронавируса. Эпидемия признана пандемией Всемирной Организацией Здравоохранения. На уровне иностранных государств, Российской Федерации, субъектов федерации, населенных пунктов, организаций и учреждений осуществляются меры по борьбе с пандемией: закрыты границы стран, введены карантинные меры для граждан России и иностранцев. Многие страны закрыты на въезд, такого не было никогда в современной истории. Россия закрыта на въезд, ТАКОГО НЕ БЫЛО НИКОГДА В СОВРЕМЕННОЙ ИСТОРИИ.
С 2010 года ответственность турагента и туроператора четко разделена. Агент действует по поручению и за счет туроператора. Агент — это посредник. Агент все свои обязательства выполнил: забронировал и оплатил тур, то есть полностью отработал свою часть. Все остальные вопросы по возврату и переносам решает туроператор. По договору о реализации туристского продукта, заключенному турагентом, туроператор несет ответственность за неоказание или ненадлежащее оказание туристу и (или) иному заказчику услуг, входящих в туристский продукт, независимо от того, кем должны были оказываться или оказывались эти услуги.
Согласно ст. 10.1. ФЗ «Об основах туристской деятельности в РФ», туроператор является лицом (исполнителем), обеспечивающим оказание услуг, входящих в туристский продукт.
