Вы помните ту ужасную аудиозапись классного часа, которую мне прислали в конце августа, и которую я разместил на своей странице? О ней говорили ведущие радиостанции и телеканалы страны. Все, от школьных библиотекарей до министра образования, были поражены: директор Петергофской гимназии Никитина, обсуждая с одиннадцатиклассниками поведение в социальных сетях, цитировала их нецензурные записи прямым текстом. Дошла эта запись и до прокуратуры. И что же вы думаете?
Я получил сегодня письмо из суда. Пишут, что профсоюзный деятель Сенников, тот самый, что сидит в здании Петродворцового РОНО и призван защищать педагогов от несправедливых действий чиновников, осенью написал прокурору письмо. Он вспоминал об этой записи и жаловался, что в ней Никитина, теперь уже уволенная, упоминает имена выпускников — в самом начале она спрашивала: «Где Генрих? А Иванов здесь?»
Прокуратура больше месяца исследовала вопрос и пришла к выводу, что из опубликованной записи действительно можно понять, что Генрих и Иванов учились в Петергофской гимназии. Они, впрочем, этого и не скрывали никогда: это на их страничках В_Контакте написано. К моменту публикации аудиозаписи они уже, правда, из гимназии выпустились, но и это оказалось не важно. За совершение административного правонарушения, состоящего в раскрытии персональных данных Иванова и Генриха, положены наказания в виде предупреждения или штрафа от трёхсот до пятисот рублей. Прокурор возбудил дело и передал его в суд.

Послушайте ещё раз и запомните: как выявила прокуратура Петродворцового района Петербурга, проблема вовсе не в том, что должностное лицо в стенах школы общается с детьми матом. Это — пожалуйста. Проблема в том, что в начале классного часа директор гимназии обращается к учащимся по именам. И поэтому публикация аудиозаписи является разглашением их персональных данных. Со всеми вытекающими.
Так вот, друзья, информирую, чтобы вы сами под суд не попали. Если вдруг вздумаете сказать кому-то, или где-то написать, или, не дай бог, со сцены во время родительского собрания произнести «Мой ученик Генрих занял первое место на олимпиаде», «Выпускник Иванов закончил нашу школу на все пятёрки», «Мы с коллегой Шляхтиным разработали новую методику» или даже «Мой одноклассник Мирон классно играет на гитаре», то знайте: найдутся и доносчик, и прокурор. Через многие месяцы вас найдут, привлекут и накажут. За раскрытие персональных данных. Вам всё ясно?
Я, разумеется, спорить с судом и прокуратурой не буду. Осудили так осудили. Пусть глумятся над здравым смыслом от имени правосудия страны без моего участия. Я лучше из профсоюза выйду.
